SpaceX Fights to Keep Contractor Bankruptcy Open Over $1.8 Million Transfer

SpaceX is urging a federal judge to keep Alpha Building's bankruptcy case active to investigate nearly $1.8 million transferred before the filing.
Space Exploration Technologies Corp. is seeking to keep an active bankruptcy proceeding open for contractor Alpha Building, arguing that approximately $1.8 million transferred from the contractor's account prior to its filing could be recovered for the estate.
The disputed funds were disbursed shortly after SpaceX and Alpha Building resolved an underlying business disagreement. Following the settlement, the contractor transferred nearly $1.8 million out of its accounts before entering bankruptcy protection.
In court filings, SpaceX maintained that the bankruptcy estate retains potential preference or transfer claims to claw back the funds. Attorneys for SpaceX argued that closing the case prematurely would prevent creditors from investigating the movement of assets and recovering the money.
Alpha Building, which provided construction and development services prior to its financial distress, has been working through bankruptcy proceedings to resolve outstanding debts. Representatives for the debtor have sought to conclude the case, while SpaceX contends that an inquiry into the pre-bankruptcy transfers must take place first.
The federal bankruptcy court overseeing the matter has not yet issued a final ruling on whether to maintain the open case or allow the estate to move toward final distribution and closure.
